FLOW LAGREE RELEASE OF LIABILITY, WAIVER OF CLAIMS & ASSUMPTION OF RISK AGREEMENT

All participants must be 18 years of age or older.

PLEASE READ CAREFULLY

In consideration of Flow Lagree Studio Inc. (“Flow Lagree”) permitting me to participate in fitness activities offered by Flow Lagree, including but not limited to Lagree, Megaformer, Microformer, mat, reformer, strength, conditioning, mobility classes, private training sessions, group training sessions, and the use of related equipment or amenities (collectively, the “Activities”), I agree to the terms and conditions set out in this Release of Liability, Waiver of Claims and Assumption of Risk Agreement (the “Agreement”).

The Activities may take place at premises owned, operated, or made available by third parties, including but not limited to Gaia, located at 8711 Alexandra Road (the “Premises”).

ASSUMPTION OF RISK

I understand that participation in the Activities involves physical exertion and inherent risks, including but not limited to muscle strains, sprains, falls, equipment-related injuries, aggravation of existing conditions, serious injury, permanent disability, death, or property damage.

I acknowledge that these risks may arise from my own actions, the actions of other participants, the condition or use of equipment, instruction provided or not provided, environmental conditions, or circumstances beyond the control of Flow Lagree.

I voluntarily choose to participate in the Activities and freely accept and assume all risks, whether known or unknown, foreseeable or unforeseeable.

I acknowledge that I am responsible for determining whether I am physically capable of participating in the Activities. I agree to consult a medical professional before participating if I have any health concerns, injuries, medical conditions, limitations, or questions regarding my ability to safely participate.

RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in the Activities, I hereby waive, release, and forever discharge Flow Lagree Studio Inc., its owners, directors, officers, employees, instructors, contractors, agents, representatives, successors, assigns, and any facility partners involved in providing the Activities (collectively, the “Releasees”) from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to my participation in the Activities or my presence at the Premises.

This release applies to claims relating to personal injury, illness, death, property damage, or loss, including claims arising from negligence, breach of contract, or breach of any statutory duty of care, including duties owed under the Occupiers Liability Act (British Columbia).

I understand that this Agreement does not waive or limit any rights or protections that cannot legally be waived under applicable law.

COVENANT NOT TO SUE AND INDEMNITY

I agree not to commence or maintain any claim, action, or proceeding against any of the Releasees for any matter released under this Agreement.

I further agree to indemnify and hold harmless the Releasees from any claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising from my participation in the Activities or my breach of this Agreement.

PARTICIPANT RESPONSIBILITIES

I agree to:

• Follow all safety instructions provided by Flow Lagree instructors and staff;

• Use equipment only as instructed;

• Inform Flow Lagree of any injuries, limitations, or conditions that may affect my ability to safely participate;

• Stop participating if I experience pain, dizziness, discomfort, or any condition that may make continued participation unsafe.

PERSONAL PROPERTY

I acknowledge that Flow Lagree and the Releasees are not responsible for any personal property that is lost, stolen, or damaged while at the Premises.

EMERGENCY MEDICAL AUTHORIZATION

In the event of an emergency where I am unable to provide consent, I authorize Flow Lagree representatives to seek appropriate emergency medical assistance on my behalf. I understand that I am responsible for any costs associated with medical treatment.

SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.

ACKNOWLEDGEMENT AND ACCEPTANCE

I acknowledge that:

• I have read and understood this Agreement;

• I understand that I am waiving certain legal rights, including the right to bring claims against Flow Lagree and the Releasees for matters covered by this Agreement;

• I am voluntarily participating in the Activities and accepting the risks involved.

By checking the acceptance box during booking, I confirm that I have read, understood, and agree to be legally bound by this Release of Liability, Waiver of Claims and Assumption of Risk Agreement.
